Supreme Court to Deliver Ruling on Kpandai Parliamentary Election Rerun on January 28

The Supreme Court of Ghana has fixed Wednesday, January 28, 2026, to deliver its ruling on an application challenging the annulment of the 2024 Kpandai parliamentary election.
The date was announced during proceedings held on Tuesday, January 13, 2026, following submissions by parties involved in the case.
The application was filed by the sitting Member of Parliament for Kpandai, Matthew Nyindam, who is seeking to overturn a decision of the High Court (Commercial Division) in Tamale. The High Court had earlier annulled the parliamentary election results and ordered a rerun.
Counsel for the MP, Gary Nimako Marfo, argued before the Supreme Court that the High Court lacked the jurisdiction to hear the election petition filed by the NDC parliamentary candidate, Daniel Nsala Wakpal. According to the applicant, the petition filed on January 25, 2025, was fundamentally defective and therefore incapable of properly invoking the jurisdiction of the court.
He contended that the High Court erred in assuming jurisdiction and granting reliefs that led to the nullification of the election.
The High Court’s decision, delivered on November 24, 2025, nullified the entire Kpandai parliamentary election and directed the Electoral Commission (EC) to conduct a rerun within 30 days.
However, the Supreme Court subsequently ordered the EC to suspend all steps and activities toward conducting the rerun, pending the final determination of the case. This directive halted preparations for the rerun, which had been scheduled for December 30, 2025.
The ruling expected on January 28 will determine whether the High Court’s decision stands or is set aside.
