Lawyer Appiah Kubi has declared his unwavering commitment to defending the rule of law and the rights of Chairman Wontumi, stating that he is prepared to sacrifice his career if necessary.
Speaking on Pure FM, Appiah Kubi addressed recent developments in the ongoing case, including the court’s dismissal of a submission of no case filed on behalf of Chairman Wontumi.
According to him, the matter in question does not directly concern Chairman Wontumi as an individual, but rather Akonta Mining Company Limited. He emphasized a fundamental principle of company law established in Salomon v Salomon & Co Ltd, which clearly distinguishes a company as a separate legal entity from its owners or directors.
Appiah Kubi further revealed that there is documented evidence showing that Akonta Mines itself had written to the Western Regional Security Council, reporting that unauthorized individuals were engaging in illegal mining activities on its concession and requesting their arrest. Despite this, he noted that none of these individuals have been prosecuted.
He questioned why attention has shifted to Chairman Wontumi, despite the absence of direct evidence linking him to the alleged activities.
During cross-examination, Appiah Kubi pointed out that prosecution witnesses admitted they had never physically seen Chairman Wontumi on the mining site. One witness stated they had only seen him on television, while another confirmed that Wontumi had no involvement in the gold mined on the land.
Addressing the issue of concession assignment, Appiah Kubi explained that under Ghanaian law, a valid assignment must be supported by proper documentation, particularly a formal letter. He stated that evidence presented before the court shows that Chairman Wontumi had no involvement in any such assignment.
He concluded that the charges against Chairman Wontumi lack legal basis, stressing that under the law, a person cannot be arrested or prosecuted unless all the essential elements of an offence are established. It was on this ground that the defense filed the submission of no case.
Appiah Kubi reiterated that his stance is not merely about defending an individual, but about protecting the integrity of the legal system and ensuring that justice is applied fairly and in accordance with the law.
